
The court ruled that former President Yoon Suk Yeol’s charge of leading a civil war and former Defense Minister Kim Yong-hyun’s charge of carrying out an important civil war mission are established. He argued that declaring an emergency is the president’s own authority, but he faces criminal charges.

The Seoul Central District Court’s Criminal Agreement Department 25 (Judge Ji Gwi-yeon) held a first trial hearing on former President Yoon on the 19th. “It was a riot in which he entered the National Assembly by helicopter and fought with his manager, and many people moved to the National Assembly and arrested him,” the court said. “If not, it is likely to be powerful enough to undermine the tranquility of Seoul and the Seoul metropolitan area, where the National Assembly and the National Election Commission are located.”
“It is hard to deny that the Yoon Suk Yeol intended to disrupt or paralyze the functioning of the National Assembly and not function properly for a considerable period of time. It is also acknowledged that they sent troops to cause riots,” he said.

The court said, “There seems to have been a riot in that Yoon Suk Yeol and Kim Yong-hyun were not involved individually,” but added, “The Supreme Court precedent suggests that they should take full responsibility for the rebellion even if they are not involved individually.”
Since this is the first trial, an appeal is expected. Regarding the military’s dispatch to the National Assembly after the impeachment trial, he said, “The purpose of blocking and paralyzing parliamentary activities is clear, and the court seems to have judged it seriously.”
